Attorney Josh Hayes Settles Car Wreck Case in St. Clair County

Attorney Joshua P. Hayes reached a favorable settlement for a client that was involved in a one vehicle accident.  The client was a passenger in a car where the driver lost control of the car and hit a tree.  The driver died at the scene and the client suffered extensive injuries requiring surgery and therapy.  Mr. Hayes successfully negotiated a policy limits settlement with the insurance company.

Initially, the insurance company denied coverage based on the Alabama Guest Statute, which generally prevents a passenger from recovering against the driver of a car in which the passenger is traveling.  The law does provide a few exceptions, however.  In this case, we were able to prove that the driver was speeding on wet roads and that he was intoxicated.  An accident reconstructionist hired by the firm also established, by downloading the car’s ECM (electronic control module) or “black box”, that the driver was not only speeding, he was driving erratically just before this tragic wreck
