Partner Joshua P. Hayes recently settled a lawsuit in federal court which followed a horrific three vehicle crash that left our client severely injured. The at-fault driver, while speeding in a vehicle owned by a large pharmaceutical company, ran a red light at an intersection in Tuscaloosa County, and violently crashed into our client’s vehicle and then uncontrollably propelled across the intersection colliding with a Waste Management truck.  Alcohol was a contributing factor, as the adverse had been partying prior the wreck. After initially having provided false information, the adverse driver finally confessed to officers at Tuscaloosa Police Department, 10 days after the wreck, that he was driving the vehicle that caused this wreck.

Our client was severely and traumatically injured, suffering severe and excruciating pain, clavicle fractures, multiple rib fractures, closed head injury, subarachnoid hemorrhage, multiple facial lacerations, nostril fracture, extensive eye lacerations & severed eyelid, collapsed lung, lung contusion, fractured thumb and finger, and fracture to the base of his skull. As a result, our client had to undergo surgeries and extensive treatment with numerous physicians, a neurosurgeon, plastic surgeons, ophthalmologist, therapy and chiropractic treatment.

Mr. Hayes filed suit in federal court and in the meantime successfully negotiated a $965,000 settlement with the pharmaceutical company’s insurance company and also with our client’s underinsured motorist carrier compensating our client for pain, suffering, emotional distress, and loss of ability to engage in all daily activities prior to this wreck.
