Oil Spill Settlement Preliminary Approval

Everyone has heard about the BP spill of 2010, however, not everyone knows that this year the District Court for the Eastern District of Louisiana approved a settlement that may qualify many individuals and entities for compensation. On May 2, 2012 the Court issued a Preliminary Approval to the proposed Economic and Property Damages Settlement and the proposed Medical Benefits Settlement. The Court will hold a Fairness Hearing to determine whether to grant final approval to these settlements on November 8, 2012.
Economic and Property Damages Settlement applies to individuals who between April 20, 2010 and April 16, 2012 lived in, worked in, were offered and accepted work in, owned or leased real or personal property or a vessel in any of the affected areas; and entities that were doing business, owned or leased real property in the affected areas on those dates. If you are one of those individuals or entities you may claim compensation for various damages including: loss of income, earnings or profits; compensation for physical damage to vessels, coastal and wetland real property; and compensation for accounting required in preparation of your claim. If you wish to be excluded from the settlement you may opt out by submitting such request by October 1, 2012.
Medical Benefits Settlement applies to persons who: 1.) worked as clean-up workers at any time between April 20, 2010 and April 16, 2012; 2.) resided in Zone A for at least 60 days between April 20, 2010 and September 30, 2010, and developed one or more specified physical conditions; or 3.) resided in Zone B for at least 60 days between April 20, 2010 and December 31,2010.

Under the Medical Benefits Settlement you may qualify for compensation for: (1) bodily injury and any progression of the bodily injury, or wrongful death and/or survival actions as a result thereof; (2) loss of support, services, consortium, companionship, society or affection, or damage to familial relations arising out of any bodily injury to another person, and any progression of bodily injury to another person, or wrongful death and/or survival actions as a result thereof; (3) increased risk, possibility, or fear of suffering in the future from any disease, injury, illness, emotional or mental harm, condition, or death; and (4) medical screening and medical monitoring for undeveloped, unmanifested, and/or undiagnosed conditions.
