Prince, Glover & Hayes Partner Josh Hayes Settles Playground Injury Case on Day 3 of Trial

PG&H Partner Josh Hayes settled a case, following 3 days of testimony, involving a 5 year old boy who was traumatically injured when he fell down a “fireman’s pole” onto concrete.   The case, pending in Greene County, was amicably resolved following the testimony of the plaintiff’s expert witness, a mechanical engineer, who testified strongly that the playground was unreasonably dangerous because it did not have a proper “fall attenuating” surface designed to soften a child’s fall.   The jury heard that falls on playground are known risks and, as such, the designer and builder of playgrounds had a duty to safely design the playground to minimize risks to children.   The settlement reached will take care of the plaintiff’s past and future medical care and also compensates him for the pain and suffering he has endured.
