Prince, Glover & Hayes Reaches Substantial Settlement in Tractor-Trailer Wreck Case

Partner Josh Hayes has reached a substantial settlement in a tractor-trailer wreck case that occurred on 15th Street in Tuscaloosa. The defendant tractor trailer driver attempted to make a wide right turn from the far left lane, crossing over all three lanes of traffic. Our client was in the right lane and her car was pushed under his tractor trailer. She sustained serious injuries, including a punctured lung and a serious arm laceration. She spent seven days in the hospital and underwent numerous surgical procedures. She also had to have the assistance of a home health care nurse for a month. She continues to suffer from her injuries sustained in the wreck.

Mr. Hayes hired a transportation and safety compliance expert to look at the case. The expert found that the tractor-trailer driver had multiple speeding tickets and accidents and was driving in violation of the 14 hour max on duty driving rule. In addition, the company the driver worked for was in violation of numerous Federal Motor Carrier Safety Regulations- they failed to correctly qualify him, failed to properly conduct annual reviews, accepted the driver’s falsified driving logs, and dispatched him even though he was in violation of the 14 hour rule. With such a strong case against the defendants, they decided to settle. In addition, Mr. Hayes increased our client’s recovery amount by working with Blue Cross Blue Shield to achieve a reduction in her medical bills.
