Tragic Wrongful Death Case Settled On the Eve of Trial

Partner Josh Hayes was successful in resolving a wrongful death case just days before the trial was to begin. Over five years ago, a young man was shot and killed by a family member. In addition to the criminal case, the family hired Josh to pursue a civil case against the shooter. Despite numerous delays as a result of the criminal process, the firm was able to eventually negotiate a favorable settlement.

In addition to the wrongful death case and the criminal proceedings, the shooter’s insurance company filed a declaratory judgment suit against the estate of our client, claiming the company shouldn’t have to pay due to the shooting being intentional on the homeowner’s part. The trial court ruled in our favor and the case was on appeal to the Alabama Supreme Court when a full policy limits settlement was reached.
